Overview

The EB-1A visa category is designed for individuals who have risen to the very top of their field of endeavor in the sciences, arts, education, business, or athletics. Unlike many employment-based pathways, it does not require a specific job offer or labor certification, allowing individuals to self-petition.

However, the evidentiary threshold is exceptionally high. Adjudicators conduct a two-part analysis (known as the Kazarian framework): first determining if at least three regulatory criteria are met, and second, determining if the totality of the evidence demonstrates extraordinary ability.

Crucial Notice: Simply satisfying three criteria (the initial evidentiary threshold) does not automatically establish eligibility. The totality and quality of the evidence remain critical in the final merits analysis. No one qualifies based merely on meeting a mathematical minimum.

Who May Consider EB-1A?

  • Highly cited scientists and researchers
  • Founders and executives with major commercial success
  • Innovators holding impactful patents
  • Artists and creatives with international exhibitions
  • Athletes performing at the highest competitive levels

Understanding the Regulatory Criteria

Petitioners must provide evidence of a one-time major achievement (like a Nobel Prize) OR meet at least 3 of the following 10 criteria.

1. Receipt of lesser nationally or internationally recognized prizes or awards.

2. Membership in associations that require outstanding achievements.

3. Published material about you in professional or major trade publications.

4. Participation as a judge of the work of others in the same or an allied field.

5. Original scientific, scholarly, artistic, athletic, or business-related contributions of major significance.

6. Authorship of scholarly articles in professional or major trade publications.

7. Display of your work in the field at artistic exhibitions or showcases.

8. Performance of a leading or critical role for distinguished organizations.

9. High salary or other significantly high remuneration.

10. Commercial successes in the performing arts.

Common Weaknesses in EB-1A Cases

  • Over-reliance on weak criteria: Trying to stretch evidence to fit criteria where the petitioner's impact is minimal.
  • Failing the final merits analysis: Even if 3 criteria are met, the evidence must collectively show the person is at the "very top" of their field.
  • Poorly structured evidence: Throwing hundreds of pages at an adjudicator without a clear roadmap or index.
  • Vague recommendation letters: Letters that offer praise without providing specific, verifiable examples of major impact.
